When the bank forecloses on a house, do they own the belongings inside of the home as well?
I have a roommate who owns the house where I currently reside, and it is headed for foreclosure. I have no ties to the mortgage or any other bills for the house. My question is, if the house is foreclosed upon, are my furniture and belongings at risk of being confiscated? I live in North Carolina, just in case it might vary from state to state.
answers:
The bank does not keep the stuff inside the home. The people will be given a move out day. Now if you leave stuff in the home after that date the bank can toss it then.
If I were you I would move out now and find someplace else to live. No reason for you to deal with this.

James asks…
If a neighbor's home foreclosed and they abandoned a classic (junk?) car in their driveway, can I claim it?
Ok, so a neighbor foreclosed. Not good news, for them or me. They cleared the home of possessions and the last I've seen of them was two weeks ago. Now there's a sticker on the door. They have a '68 Mercury Cougar sitting on the driveway that never moved in all 7 years I've lived in the neighborhood. Beautiful car that I doubt runs but wondering if it is salvageable as a classic restoration project. I asked the neighbor about it years ago. He said it ran but the wife wouldn't part with it for sentimental reasons. It was her deceased dad's car. Are they ever coming back for it? Has the car been "claimed" somehow as bank property? How do I find out? I'd love to make some lemonade out of my situation and restore this car for myself. Would it be a crime if I had it towed over to my house? This is in North Carolina. Thanks.
answers:
No. You cannot claim someone else's property. Yes it would be a crime to move it. It is not yours. It belongs to someone and that someone is not you.

Laura asks…
can i be fired for having scabies in nc?
yesterday i woke up with a rash. so did my daughter. i called my employer (a dentist) and told her i needed to be seen by my physician because it obviously is contagious. my doctor diagnosed me with scabies and gave me a prescription for some ointment and shampoo. she told me i would need to stay out one more day but would be safe to return to work and work on patients the following day. i called my employer (the dentist) and told her what i had and that i would have to miss one more day, and that i had a work excuse note from my doctor to return the day after that. my employer said she didn't care what my doctor said, that she she did not feel comfortable with me returning that soon. she said that i couldn't return until she said so, but she felt at least three weeks. she said she would call me when i could return. we hung up and i felt it was on good terms. less that five minutes later she called me back. she said since she wasn't going to let me return for a minimum on three weeks, she couldn't do without the help, and said she was going to fire me, so that she could look for another employee. (she could have hired a temporary dental assistant from many of the local temp agencies instead of completely getting rid of me.) I also should add that i had received my final written warning for being out for the death of my mother, the death of my father in law and the bank foreclosed on my home which i lost. all of this has happened to me in the last six months, and now this.
when she told me i would have to stay at home for the next three weeks, i asked her if i could file for partial unemployment since my doctor had cleared me to return to work, and basically it was her rule that i had to stay out. she laughed at me and said "go ahead if you think you can get it !"
someone please help me!! I need to know if i have a legal avenue to pursue here, in north carolina
sincerely

Your boss is not a medical doctor by any means, while returning the next day does seem a bit short to me, the workers union will not permit this and you need to talk to them because they will stop this from happening in an instant.

Bank taking mopney for loan.?
I had a home equity payment loan that was two months past due. The bank sent me a notice saying I had to pay by the 30th of January or they would consider foreclosing, not a problem becaus I can now pay. The letter was recieved yesterday. Today I sent a check to pay the payments for the loan off. Which would have arrived and payed off the payments before the 30th of January. However when I checked my bank account the loan officer had telephone transfered the money to the account without my approval beforehand, after I had sent the check. No where on the notice I recieved yesterday said that wehn I had money in my account it would be taken out for the payments. I then had to cancel the check. My question is can this legally be done without notice even when I complied to pay by check? This happened in North Carolina if that makes a diffrence.
answers:
If you borrowed the money form the same bank where your checking/savings account is, they can take your money if your payments are overdue.

Help with buying a foreclosure!?
I found a REO house that i want to buy in wilmington, nc, but when i contacted the bank they said that the home was foreclosed through Maryland and not North Carolina so i have to wait on the MD courts. What can i do as a next step to try and buy the house?
answers:
Contact a Realtor.
It's up to the lender (regardless of location) to list the property with a real estate agent whenever it decides it wants to sell the property.
There are plenty of REO properties that aren't on the market yet. And if they're not, then there isn't much you can do now to buy it.
However, a Realtor can set up a "watch" on properties, so that as soon as one matching whatever criteria you need (and to target a specific property, the address or street name could be entered) gets listed, you're automatically notified.
Also, there tend to be a limited number of agents who handle REO properties (because the lenders prefer working with a limited number of agents). You should have your own agent, but yours will know (or can find out) which agents handle properties for that particular lender, and may be able to find out from those agents when the property you're interested in might become available.
So: Find a Realtor in Wilmington, explain what you're after, and take it from there.
Hope that helps.
